The service available with the URL https://www.alumnicn.com/ (hereafter the « website » or the « ICN Alumni service ») is edited by the ICN Alumni association (hereafter « the Association »). This website aims to create a community of former students and graduates of ICN Business School.

This document is a contract between the user of the website (the "User" or "You") and the association (the "Party" or "Parties").

Article 1. Purpose and general rules

The following general terms and conditions of use (hereafter the "Terms of Use" or "TOU") define the conditions under which users can access the website and use the ICN Alumni Services. They have a contractual value.

 

Article 2. Terminology et definitions

Within the framework of these general conditions, the terms listed below, when capitalized or when they begin with a capital letter, shall have the following meaning:

  • Website: refers to the internet site belonging to the Association, available at the following address " www.alumnicn.com" and giving access to the services offered by the Association.
  • Users: refers to members who can access the services thanks to a personal account. Members can be students of the School, graduates of the School, recruiters, representatives of a partner company. These Users can have the status of contributors. For each type of User, access to the Services may be limited according to their status.
  • Personal Account: refers to the account associated, created and validated by each User, enabling him/her to access the services offered by the Association.
  • Content: refers to all the information concerning the Users on the Website, including their Personal Data but also any other content concerning them.
  • ICN Alumni Services: refers to the services provided by the Association through its Website.

 

Article 3. Acceptance of the TOU and updates

The current TOU are made available to Users through various pages of the Website where they can be directly consulted and are always easily accessible.

The acceptance of the present TOU when creating or activating a Personal Account is necessary to be able to use the Website and access the ICN Alumni Services.

By checking online the box "I have read and accept the Terms of Use of the ICN Alumni website", you, as a User, confirm that you accept without restriction or reservation the Terms of Use.

We reserve the right to modify the Terms of Use at any time. In this event, the new TOU version will be published on the pages of the Website and Users will be alerted by a pop-up window that will appear when logging into their Personal Accounts.

 

Article 4. Services provided by the Association

The Association offers, via the Website, access to its ICN Alumni Services allowing Users to build a network of professional contacts.

Creation and activation of a Personal Account are free and allow Users to access the free-of-charge services listed below. Therefore, the non-contributing Users have access to the following services:

  • Visiting pages of the Website (practical information, nominations, notebooks, business creation)
  • Posting of job offers

Contributing Users have access, upon payment of subscriptions, to the following services:

  • Visiting pages of the Website (practical information, nominations, notebooks, business creation)
  • Profile in the graduate book
  • Posting of job offers
  • Access to job offers and notifications
  • Access to the online alumni database
  • Access to the candidate library
  • Events creation in the calendar
  • Participation to events created by partners
  • Access to our partner’s events (NQT, Est'elles Executive, ...)
  • Access to the ICN Award
  • Access to the ICN Youth Award
  • Right to vote at the general meeting

                                                                                                                                              

Article 5. Access to the Services

5.1 Registration to the Services

The User, before creating or activating the Personal Account, declares that he/she has full legal capacity, allowing him/her to commit to the present TOU. 

Furthermore, the User who registers in order to publish job offers, must be fully authorized to use the Website for this purpose by the company that employs him/her. Therefore, if you use the ICN Alumni Service on behalf of a third party, in the name of a company or another legal entity, you warrant that you are fully authorized to represent this organization.

The Association cannot be expected to verify the legal capacity of the Website Users. Consequently, the Website User acknowledges that he/she has the necessary skills and means to access the Website.

To create or activate a Personal Account, the User must be

  • A graduate or student of ICN Business School
  • A recruiter

 

            5.2 Personal Account

When creating or activating the Personal Account and throughout the use of the Services, the User guarantees that the data communicated is accurate and true. In case of modification of the data communicated during the use of the Services, the User agrees to modify as soon as possible the information on his Personal Account. 

When the requirements for registration are fulfilled, the User has a personal identifier and a password. The identifiers and passwords are strictly personal and confidential, they must not be communicated or shared with third parties. Each User agrees to create only one personal space matching his profile.

Therefore, the Website User is responsible for his/her Personal Account from the date of activation.

The Association reserves the right to cancel the Personal Account of any User who spreads or uses its confidential elements in a manner contrary to their intended purpose. If the creation or activation of the Personal Account has been carried out in violation of the TOU, the User will no longer be authorized to use the Services.

 

Article 6. Obligations and commitments of the Users

By using the Website and ICN Alumni Services, the User commits to:

  • Comply with the stipulations described in the TOU and the applicable laws, and respect the rights of third parties
  • Expressly agree that his/her testimonies and comments may be reproduced freely and represented in various communication supports to promote the Association
  • Not to use an alias or e-mail address that could damage the rights of third parties (family name, brand name, etc.), nor to usurp a name, a company name or a registered trademark
  • Guarantee to the Association that he/she has the necessary rights, including all intellectual property rights on the testimonies, comments, images and data of any kind that he/she discloses on the Website, allowing him/her to grant these rights 
  • Only communicate information, files and other content that are true, honest and fair. For this reason, the recruiting User expressly guarantees the truthfulness and reality of the information transmitted to candidates (position to be filled, profile requested, information concerning the company, etc.)
  • Not to disclose or put online third parties personal information (texts, photos and videos) without their consent
  • Not to disseminate any illegal content, and in particular any content that is infringing, defamatory, insulting, obscene, offensive, discriminatory, violent, xenophobic or inciting to racial hatred; or any other content that is contrary to good manners and the rules of good behaviour
  • To use the Website and the ICN Alumni Services only for purposes consistent with those described in the TOU and therefore, not to communicate content that is contrary to the purpose of the Website and the ICN Alumni Service
  • Not to communicate or send, through the Website, any content that includes links to illicit or offensive websites or that are incompatible with the purpose of the Website.

 

Article 7. Financial terms

7.1 Membership

Payment: The limited use of the Website and ICN Alumni Services is free. The User may however choose either a one (1) year membership or a lifetime membership in order to access all the services offered by the Association. The User must then pay a membership fee, the duration, price and terms of which are detailed on the pages of the Website. 

Withdrawal period: the regulation offers the possibility to the consumer to withdraw within a maximum period of fourteen (14) days from the date of the order for a service or the delivery of the good. However, it should be noted that the withdrawal period does not apply in the case of "digital content not provided on a physical medium, the execution of which has begun after the consumer's prior express agreement and explicit renunciation of his right of withdrawal".  Therefore, and since the services offered via the Website are digital contents, the User expressly relinquished his/her right to withdraw by accepting the Terms of Use.

7.2 Terms and condition of payment

The membership fee is payable in euros.

Payment of the membership by the User is made directly online via a secure interface edited by a payment institution, partner of the Association. The User can choose, if he takes a lifetime membership, to pay in four (4) instalments without additional charges.

Once the User has completed the various stages of the online order, validated and paid for the chosen membership, the Association will send an email confirming the order, including a PDF copy of the TOU.

The invoices, issued for each order, are accessible on the User's Personal Account. 

 

Article 8. Intellectual property

8.1 Content published by the Association

The content of the Website, especially its structure, design, interfaces, databases, texts, trademarks, images, videos, music and graphic elements, as well as the HTML referencing tags (meta-tags), excluding the content belonging to Users, are the exclusive property of the Association. This content is protected by the Intellectual Property Code and by any national or international text applicable to intellectual property law. 

 

Therefore, all texts, software, images, videos, databases and any other work available on this Website are protected by the intellectual property code. Users of the Website agree not to reproduce them without the express consent of the Association.

Users are authorized to display on screen the pages of the Website only for personal consultation and according to the purpose of the ICN Alumni Services, as defined in the Terms of Use.

Any reproduction, distribution or use of all or part of the content of the Website in any form whatsoever, without the express prior authorization of the Association, is prohibited and would constitute an infringement, punishable by articles L. 335-2 and following of the Intellectual Property Code.

Also, the User is forbidden:

  • To extract by temporary or permanent transfer, or to use all or a substantial part of quantitative or qualitative terms from the Website for commercial or other purposes
  • To extract or use repeatedly and systematically all or part of the information visible on the Website, when such an operation clearly exceeds a normal and private use of the Website
  • To exploit, market or distribute any element of the Website, including the information visible on the Website and any other database
  • Use software or manual processes to copy our web pages or to record and collect information on these pages without the express prior written consent of the Association
  • Use any device or software to disrupt or attempt to disrupt the proper functioning of ICN Alumni Services; or take any action that would imposes a disproportionately large load on our infrastructure.

8.2 Content published by Users

The User adds and publishes content via the Website (information about him/her, photos, CVs and other texts and images, etc.) (hereinafter the "User Content"). As such, the User is and remains the owner of the rights over such content. 

However, the User grants the Association, which accepts, a non-exclusive and free license to use the User Content. This license covers the right to use the said Content and to grant sub-licenses to use it, solely for the purposes of performing the Agreement. This license shall remain in place for the duration of the Agreement. For this purpose, the User declares that he/she is duly authorized to grant licenses to use the User Content transmitted within the limits defined by the TOU.

For this reason, the Association agrees not to use the User Content for purposes other than those specified in this agreement and to take measures to prevent the misappropriation or fraudulent use of the User Content.

 

Article 9. Safeguards and service accessibility

The Association uses its best endeavors to provide Users with a quality service. However, it does not guarantee that the operation of the Website will be uninterrupted, error-free or secure.

The Association reserves the right to suspend access to the Website temporarily in order to carry out maintenance and updates. The Association will favour non-business hours and limit the duration of such operations as far as possible. The Association undertakes to inform Users on the Platform's homepage of planned maintenance operations. 

The User is informed that the Website may be subject to malfunctions and other bugs. The Association will use all means at its disposal to resolve these problems as quickly as possible and limit the resulting inconvenience to Users.

Furthermore, the Association does not guarantee that the Website will meet the needs of Users. It is the responsibility of Users to ensure that they have access to the appropriate technical means to use the services offered by the Website.

 

Article 10. Responsibilities

10.1 Services offered by the Association

The Association cannot be held responsible for the use that Users make of the Website and the ICN Alumni Services. The Association cannot be held responsible for simple errors or omissions that may have occurred despite all the precautions taken in the presentation of the Services. The Association cannot be held responsible for any damage resulting from the use of the Services. The use of the Website and the associated Services is the sole and entire responsibility of the User.

The Association shall not, in any case, be held liable for:

  • The consequences of improper use of the Website and, in general, not complying with the TOU
  • The refusal of an application by a recruiting company
  • The potential consequences, direct or indirect, of the inaccuracy of the information provided by a recruiting User
  • Any consequences that may arise during or at the end of meetings or contacts between candidates and Recruiters, following the use of the ICN Alumni Service.

10.2 Contributions to the Website 

We have no control over:

  • The User Content imported or published via the Website (legality, suitability, accuracy, relevance or currentness)
  • The capacity or quality of the Users.

We cannot be held responsible for imported User Materials. Only the User is responsible for his/her Content, and the Association is only the technical host of his/her Content. The Association has no general obligation to monitor data and User Content or to remove content that does not appear to be clearly illegal, notwithstanding its notification.

10.3 Hyperlink

The Website may include hyperlinks to third-party websites, including the websites of commercial partners. The Association shall in no way be held liable for any direct and/or indirect damage that may result from the use of content, data or information of any kind accessible from the said hypertext links. It is the User's responsibility to check that the information appearing on these partner websites is accurate, complete and compliant with the regulations. Applicability of the TOU does not extend to third party sites.

10.4 Internet network and loss of data 

The User acknowledges and accepts that the Internet, and more generally any telematic network used for data transmission purposes, may involve risks related to the lack of protection of certain data against possible misappropriation and risks of contamination by viruses. Therefore, the Association shall not be held responsible for any loss or alteration of data, loss of profit, turnover, opportunity, time or any indirect damage, whether such loss or damage is due to negligence or any other cause, in connection with the execution or non-execution of these Terms of Use.

 

Article 11. Duration and termination

The Terms of Use shall come into force when the User has completed the procedure for creating or activating the Personal Account on the Website, for the duration of the use of ICN Services and the validity and existence of his/her Personal Account.

The Association or the User may terminate the Agreement under the following conditions: 

  • In case of a request from the User to close the profile
  • If the User refuses to accept any new version of the Terms of Use
  • In case of use of the Services in violation of these TOU, or any other breach of the Terms of Use. 

In this case, the Association will send the User an e-mail notification requesting that he or she rectify the violations of the TOU within seven (7) days. If no correction is made within this period, the Association reserves the right to close the User's profile without further notice. Any profile closure initiated by the Association will be done without refund of the membership fee paid.  

In the event of termination of the Agreement for any reason whatsoever, the Association shall close the personal profile(s) concerned and delete all content transmitted via the Website by the Users concerned.

 

Article 12. Applicable law and place of jurisdiction

These Terms of Use are governed by French law. 

In the event of a litigation, the parties decide, in the first instance, to try to resolve it amicably. 

In case of failure to find an out-of-court solution, the user can address his complaint to the relevant mediator.

In case of failure, all litigations likely to arise between the parties, relating to the signature, the interpretation, the execution and the cancellation of the terms of use, will be submitted to the exclusive jurisdiction of the French courts to which the parties expressly grant jurisdiction, even in case of plurality of defendants, in summary proceedings, appeal in guarantee or by request.

The ICN Alumni Association (hereinafter the "Association") is eager to preserve the confidentiality of your personal information and greatly values the protection of the privacy of users of its services.

The purpose of the Privacy Policy is to set out the rules applicable to the collection and processing of your personal information via our ICN Alumni website (hereinafter the "Website"). It details the data we may collect about you, how we use that data, with whom we may share it, and the measures we take to ensure its security. 

Some of the links or social network buttons on the Website may redirect you to websites that do not belong to the Association. These websites have their own privacy policies that may differ from ours: it is your responsibility to read them. We are not responsible for how these websites use your personal information.

 

1. Your acceptance of our Privacy Policy 

By using our Website, you agree to this Privacy Policy. If you do not agree with any of its terms, you are free not to use our services or order from the Website. 

In general, the Privacy Policy is always easily accessible through the various pages of the Website.

 

2. Our general commitment

The processing of Personal Data of Internet users and users of our services is subject to the European Regulation 2016/679 of April 27 2016 concerning the protection of individuals with regard to the processing of personal data and on the free movement of such data (known as the "RGPD") and to Law No. 78-17 of January 6 1978 on data processing, files and freedoms, as amended (known as the " Loi Informatique et Libertés") (hereinafter the "Regulation"). 

For the purposes of this Policy, the term "personal data" means any information relating to a natural person who can be identified, directly or indirectly, with a name, first name, email and postal address, telephone number, username, password, etc. (hereinafter "Personal Data").

Regarding this Regulation, the Association is responsible for the processing of Personal Data carried out via the Website and undertakes, by means of this Policy, to comply with its obligations upon it and, in particular, to carry out lawful, fair and transparent processing of the Personal Data of the visitors and users of the Website.

3. What personal data do we collect and when?

Through the Website and the online forms, we collect Personal Data from visitors and users who wish to: 

  • Obtain information via the contact form
  • Activate and access a Student and Graduate account
  • Create and access a Recruiter account
  • Join the Association
  • Submit applications for job offers
  • Subscribe to the Newsletter
  • Register for events.

For example, the Personal Data that we collect and process are about: 

  • Information relating to your identity such as your name, first name, title, date and place of birth, family situation and nationality
  • Your personal and professional contact information such as your postal and e-mail addresses
  • Information relating to your professional life such as your CV, your functions and positions held, your mandates, etc.
  • Information relating to the administrative management of the Association: bank details and status of contributions
  • Information relating to connection data: the date and time of the connection, the IP address of the device used, the pages consulted.

In addition, the creation or activation of the online personal account may include a section offering the Association the possibility to use the Personal Data of users for marketing or commercial purposes (such as newsletters, questionnaires and information on similar services). In this case, users will be informed and will be able to object to this. 

Finally, during your visits to the Website, information relating to your navigation may be recorded in "Cookies" files installed on your terminal, subject to the choices you have expressed concerning these cookies and which you may modify at any time.

 

4. On what basis and why do we use your Personal Information?

We will only use your Personal Data if you have consented to such use or if such use is based on the protection of our legitimate interests (to respond to your questions and provide our services to you), or to comply with a legal or regulatory obligation.

We collect and process information about you for various purposes, including:

  • Set an alumni book of ICN Business School 
  • Manage the relationship with users (e.g. respond to your requests)
  • Manage the relationship with users, in particular for administrative follow-up (statistical reports), community animation and follow-up of contributions
  • Send newsletters and alerts corresponding to your selection criteria by email
  • Publish job offers
  • To improve the quality of our services (e.g., website traffic measurement and customer reviews)
  • To ensure the security of Personal Data (e.g. to prevent digital identity theft)
  • Resolve any possible litigation or solve any problem in the context of the use of the services.

Any use of Personal Information for purposes other than those described in this Privacy Policy will require your express prior consent. The Association commits to not access or use your Personal Data for any purpose other than those necessary for the performance of its services.

 

5. With whom may we share your personal data?

a) Communication for internal and external processing purposes

Your Personal Data may, where appropriate, be transmitted to:

  • ICN Business School 
  • Third parties involved in the provision of our services (technical and hosting service providers, or subcontractors for order delivery, sales invoicing, customer follow-up or security incident management, etc.).

The Association commits itself to communicating your Personal Data only to authorized and trusted service providers, who process them on our behalf, according to our instructions. 

b) Disclosure for legal and judicial reasons

Furthermore, your Personal Information may be disclosed to a third party if the Association is required to do so by law, regulation, or court order, or if such disclosure is necessary for the purposes of an investigation, injunction, or legal proceeding, whether domestic or foreign.

We may also share your Personal Information with third parties (e.g., attorneys, bailiffs, etc.) in order to enforce the Privacy Policy (including to investigate possible breaches of the Privacy Policy) and to protect the rights, property, or safety of the Association and users of our services, in accordance with the law.

 

6. How long do we keep your Personal Data?

ICN Alumni commits to keep the Personal Data processed, strictly for the time necessary for the processing of the purpose(s) mentioned above, and in any case within the limits required by the applicable regulations and legislation. This includes data provided by Users or third parties as well as data generated or inferred as a result of the use of our services. 

The duration of retention of your Personal Data may differ depending on your profile, for example: 

- for users of the Website: we keep the data until you request to unsubscribe

- for cookies: we keep the cookies for a maximum of 13 months.

However, depending on the case, we may need to keep your data for a longer period of time, in particular to comply with applicable legislation (e.g. accounting and tax obligations and statute of limitations), to manage claims and/or disputes, to defend our interests or assert our rights, or to respond to any requests for information sent by authorized third parties (administrative authorities). 

We will not keep it longer than necessary and when we no longer need it, we will securely destroy it in accordance with our internal policy or make it anonymous.

 

7. How we ensure the security of your Personal Information

We implement organizational and technical measures to protect your Personal Data against unauthorized access and disclosure, modification, alteration, damage, accidental loss or destruction, as well as against any other form of unlawful processing or disclosure to unauthorized persons.

To do so, we require our staff and our technical service providers to respect strict rules regarding security and protection of information (e.g. contractual obligation of confidentiality, use of encryption and anonymization techniques, implementation of physical security measures, etc.). 

Furthermore, we inform you that your Personal Data is stored on servers located in France and in the European Union. 

Finally, if the Association becomes aware of an incident affecting Personal Data, it commits to informing the competent supervisory authority (the "CNIL") within 72 hours of its discovery. In the event of a breach of Personal Data likely to result in a high risk for your rights and freedoms, the Association also undertakes to inform you as soon as possible, and in accordance with the conditions and procedures provided for by the Regulations.

 

8. What are your rights?

Any person involved in the Personal Data process treated by the Association has the following rights in particular: 

  • Right of access (e.g. to check the data we hold about you and obtain a copy)
  • Right to correction (e.g. to update or correct your data if it is incomplete or incorrect)
  • The right to object at any time to the collection and processing of all or part of your data for purposes of commercial prospecting, for example, including profiling as far as it is linked to such prospecting. This right offers you the possibility to modify your notification preferences at any time
  • Right to limitation (e.g. in certain cases provided for by law, and if you question the processing of some of your data, you may request that we limit the use of your data while we manage our dispute)
  • Right to portability (e.g., you have the right to retrieve your data or to require their transmission to third-party service providers)
  • Right to erasure (e.g., you may request the permanent deletion of your data stored by the Association)
  • Right not to be subjected to a decision based exclusively on automated processing, including profiling, producing legal effects concerning you or affecting you in a similar significant way
  • The right to define general and specific directives defining the way in which you intend these rights to be exercised after your death.

How to use your rights?

You may exercise these rights at any time by sending your requests, with proof of identity, to the addresses mentioned in section 10 below. If you exercise these rights, we will do our best to respond as soon as possible, and in any event within one month of receiving your request. 

If necessary, this period may be extended by two months, taking into account the complexity and number of requests addressed to the Association. In this case, you will be informed of the extension and the reasons for the delay. 

If the Association does not comply with your request, it will inform you of the reasons for its inaction and you have the possibility to file a complaint with to a supervisory authority and/or to take legal action.
